1. Company information

SIMMONS CONCRETE CONSTRUCTION LLC is a domestic limited liability company registered on March 29, 1996 in the State of Georgia, with a principal office at 12 Ventura Dr, North Dartmouth, MA 02747 and an additional address at 137 Locust St, New Bedford, MA 02740. Phone: (405) 293-8154.

2. Estimates and proposals

Estimates are based on the conditions observed and information provided at the time of the site visit and are valid for 30 days unless stated otherwise. Unforeseen conditions — including ledge, groundwater, unsuitable soils, buried debris, or code and inspector requirements — may require a written change order before work continues.

3. Scheduling and weather

Concrete placement depends on temperature, precipitation and site access. We may reschedule pours to protect the quality of the work. We are not liable for delays caused by weather, material availability, utility marking, permitting, inspections, or actions of other trades.

4. Customer responsibilities

• Provide clear, safe access to the work area and a water source when needed.
• Identify private utilities, septic systems, irrigation and invisible fencing.
• Remove vehicles, personal property and obstructions before crews arrive.
• Keep people, pets and vehicles off fresh concrete for the cure period we specify.

5. Payment

Deposits, progress payments and final balances are due per the signed proposal. Invoices unpaid after 30 days may accrue late charges at the maximum rate permitted by Massachusetts law. We reserve all lien rights available to us under applicable law.

6. Warranty and disclaimers

We warrant our workmanship against defects in installation for one (1) year from substantial completion, unless a different term is written into your contract. Concrete cracks. Hairline and shrinkage cracking, minor color and finish variation, efflorescence, and damage caused by de-icing salts, freeze-thaw cycles, soil movement, tree roots, overloading or improper maintenance are not covered. Except as expressly stated, all other warranties, express or implied, are disclaimed to the fullest extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, our total liability arising from any project is limited to the amount paid to us for that project. We are not liable for indirect, incidental or consequential damages.

10. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts. The parties will attempt to resolve disputes in good faith before pursuing any action, which will be brought in the state or federal courts serving Bristol County, Massachusetts.
